These Terms and Conditions (“Terms”) govern your use of the Parkline Gallery website (parklinegallery.com) and your engagement with our services, including the acquisition of fine art. By accessing our digital viewing rooms, communicating with our advisory team, or completing a transaction, you agree to be bound by these Terms.

1. Intellectual Property & Copyright

All content presented on this website, including but not limited to high-resolution imagery, exhibition text, curatorial descriptions, graphics, logos, and digital architecture, is the exclusive property of Parkline Gallery, its represented artists, or its content suppliers.

  • Protection of Artist Rights: The purchase of an original artwork or reproduction does not transfer the copyright of that artwork to the collector. The artist retains all copyrights and reproduction rights.

  • Prohibited Use: No image, text, or asset from this site may be downloaded, reproduced, distributed, or transmitted in any form for commercial or public purposes without prior written authorization from the Gallery.


2. Acquisitions, Pricing, and Availability

Parkline Gallery curates highly exclusive, often unique contemporary works.

  • Availability: The exhibition of an artwork on our website does not guarantee its availability for acquisition. Works are frequently acquired through private sales and may be withdrawn from public exhibition without prior notice.

  • Pricing: All listed prices, when publicly displayed, are subject to change without notice. The Gallery reserves the right to correct any typographical or pricing errors.

  • The Right of Refusal: Parkline Gallery reserves the right, at its sole discretion, to refuse service, terminate client accounts, or cancel orders to protect the integrity of the gallery and our artists.


3. Title, Risk of Loss, and Logistics

The logistics of transporting monumental and high-finish fine art require strict protocols.

  • Transfer of Title: Legal and equitable title to an acquired artwork remains with the artist or the Gallery and shall only pass to the collector upon the Gallery’s receipt of full and cleared payment.

  • Risk of Loss: The risk of loss or damage to the artwork transfers to the collector upon the delivery of the artwork to the specified destination, or upon the hand-off to the collector’s designated private shipper.

  • Crating & Transit: The Gallery coordinates professional fine art packing, crating, and insured transit. These direct logistical costs are the sole responsibility of the collector unless explicitly stated otherwise in a formal invoice.


4. Taxes, Duties, and International Acquisitions

Our collectors operate globally, and acquisitions are subject to local jurisdictions.

  • Taxes: The collector is responsible for the payment of all applicable local, state, and federal sales taxes associated with their acquisition.

  • International Import: For international shipments, the collector is solely responsible for all customs duties, import taxes, tariffs, and clearance fees levied by the destination country.


5. Return Policy

Due to the unique nature, value, and logistical complexity of fine art acquisitions, all sales of original artwork are final.* Parkline Gallery does not accept returns or issue refunds for change of mind or buyer’s remorse.

  • In the rare event that an artwork is damaged during Gallery-arranged transit, the collector must notify the Gallery within 24 hours of delivery, retaining all original crating and packing materials for insurance inspection.


6. Limitation of Liability

To the fullest extent permitted by applicable law, Parkline Gallery, its principals, employees, and affiliates shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of your use of this website, your inability to access the site, or any transactions conducted through the gallery. The website and its contents are provided on an “as-is” and “as-available” basis without any warranties, either express or implied.

7. Governing Law and Jurisdiction

These Terms and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any legal disputes arising from these Terms or the acquisition of artwork shall be subject to the exclusive jurisdiction of the state and federal courts located in New York County, New York.


8. Modifications to Terms

Parkline Gallery reserves the right to update, modify, or replace any part of these Terms at our discretion by posting updates to our website. It is your responsibility to check our website periodically for changes.
